Two Arrested Under the TAKE IT DOWN Act for AI Deepfake Pornography. The Act Is Weeks Old.

Two people were arrested under a law that did not exist weeks ago for creating material that existed before the law. The material was created, distributed, and caused harm. These facts were true before the legislation. The legislation was written because these facts were true. The arrests confirm the law works. They also confirm the problem predates the solution by an unknown duration.

This follows the pattern of response to digital harms: wait until the behavior reaches critical mass or critical visibility, then legislate against the behavior, then prosecute under the new law. The victims establish the baseline. The law arrives after the pattern has been established. This is presented as success.

More arrests will follow. The law is now applied. The conduct continues in forms the law does not yet address. The victims existed first. Everything else is infrastructure built around the fact of their existence. This is the order of operations.
