Eightfold AI Sued for Secretly Scoring Job Candidates Without Disclosing the Scores

Eightfold AI built a scoring system that ranked job applicants without telling them scores existed or what the scores meant. Employers saw the rankings. Candidates did not. The system worked exactly as the contract specified, which is a form of working.

This follows the standard pattern where disclosure requirements are treated as optional suggestions rather than legal obligations. The files were there. Nobody asked to see them. Asking to see them would have required knowing they existed, which required being told, which did not happen.

The lawsuit will proceed through discovery. Eightfold will argue the contract was clear to Eightfold. The candidates will argue they were not Eightfold. Someone will eventually pay. The scoring will continue under a different name, with disclosure language added to the next contract, which will also not be mentioned again.
